Exclusion of Liability - Assumption of Risk - Jurisdiction
These conditions will affect your legal rights including the right to sue or claim compensation following an accident.
Please read carefully.
As a condition of use of the ski area and other facilities, the ticket or season
pass holder assumes all risk of personal injury, death, or property loss
resulting from any cause whatsoever including but not limited to: the risks
dangers and hazards of skiing in its various forms, including snowboarding
and other recreational activities; the use of ski lifts; collision with natural or
man made object or with other skiers, snowboarders or other persons; travel
within or beyond the ski area boundaries; or negligence, breach of contract,
or breach of statutory duty of care on the part of Teton Pass Ski Area Inc.,
and its directors, officers, employees, instructors, volunteers, agents,
independent contractors, subcontractors, representatives, sponsors,
successors, and assigns, (herein collectively referred to as “Teton Pass Ski
Area Inc.”) The Ticket or Season Pass holder agrees that any litigation
involving Teton Pass Ski Area Inc., shall be brought solely within the State
of Montana and shall be within the exclusive jurisdiction of the courts of the
State of Montana. The Ticket or Season Pass Holder further agrees that
these conditions and any rights, duties, and obligations as between Teton
Pass Ski Area Inc., and the Ticket or Season Pass Holder shall be governed
by and interpreted solely in accordance with the laws of the State of
Montana and other jurisdictions.
The Ticket or Season Pass Holder acknowledges that skiing, snowboarding
and all other recreational activities involve risks, dangers and hazards that
may cause serious personal injury or death and that injuries are a common
and ordinary occurrence. Risks include, but are not limited to, changes in
terrain, weather, snow surfaces, ice, moguls, bare spots, rocks, stumps,
debris, fences, posts, trees, lift equipment and towers, surface lifts, light
poles, signs, buildings, roads and walkways, rails, boxes, table tops, other
jumps and other terrain features (including their approaches and the angle of
their take-off ramps, and landing areas both in and out of terrain parks),
padded and non-padded barriers and obstacles, snowmaking, snow
grooming, snowmobiles, collisions with other persons and other natural and
man-made hazards. The Ticket or Season Pass Holder acknowledges that
the risks in the sport of Alpine Skiing and Snowboarding can be greatly
reduced by taking lessons, abiding by the Skier Responsibility Code (known
as Your Responsibility Code), and using common sense.
Teton Pass Ski Area Inc.’s liability is excluded by these conditions.
